By Rajesh Saha: The Central Bureau of Investigation (CBI) has filed a case against the Kolkata Police and a Jharkhand-based businessman for allegedly misleading the court, the Enforcement Directorate (ED) officials and other central government employees.

Last year, on July 31, a Jharkhand-based businessman, Amit Agarwal, filed a complaint against an advocate of Jharkhand High Court, Rajeev Kumar, at Hare Street police station in Kolkata.

According to Amit Agarwal's complaint, advocate Rajiv Kumar was seeking a bribe of Rs 10 crore and extorting the money in exchange for dismissing a Public Interest Litigation (PIL) that was filed against Amit Agarwal.

He also claimed to have call records proving Rajiv Kumar was demanding illegal bribes.

Based on his complaint, a case was registered against the HC advocate and the Hare Street police station initiated an investigation against him.

As a part of the probe, the Kolkata Police summoned a higher official from the ED to question him.

In response to the summons notice, the ED approached Jharkhand High Court alleging that the Kolkata Police were framing a false case. The ED also registered an Enforcement Case Information Report (ECIR) and ordered a probe into the case.

The Jharkhand High Court directed the CBI to start a preliminary inquiry.

As per the CBI, after conducting a preliminary inquiry, it was revealed that it was a prima facie offence. A case was registered against the accused under relevant sections of the Indian Penal Code (IPC).

The CBI further claimed, that Amit Agarwal made a false statement to the Hare Street police station, and rather he influenced Advocate Rajeev Kumar to take a bribe to dismiss the PIL. Amit Agarwal persuaded Rajeev Kumar to use his good contacts with judges to have the PIL dismissed and he also offered him money for the same.

"On July 31, Agarwal called Rajeev Kumar, handed over Rs 50 lakh, and got him trapped by the Kolkata Police," the CBI said. They further claimed that after conducting the preliminary inquiry, the real face of Amit Agarwal was exposed.

On Thursday, the CBI registered an FIR against the accused and a few officials of Kolkata Police for harassing government officials in a false case. It has already started its investigation and conducted raids at different places in Jharkhand and Kolkata.
